• Understand:  In copyright terms, to record a song is to make a 'derivative' work from it.  The copyright holder must give his/her permission for this.  In order to promote free expression, however, Congress decided that anyone should be allowed to record and sell their own version of any published song in exchange for a small payment for each copy made, paid to the copyright holder.  Because songwriters are forced or compelled to give permission, these permissions are called 'compulsory' licenses because songwriters must give them.

• Know:  These terms--cover version, mechanical license, compulsory license, master use rights, the Harry Fox Agency.

 

• Understand:  Fear of theft has made copyright holders add technical protection to their works, aka Digital Rights Management (DRM), to prevent illegal copying.

• Know:  DRM restrictions can make creating legal archival copies difficult or impossible, and may lock customers into a particular media platform.

• Do:  The Free Software Foundation says that DRM gives media and technology companies more control over their works than copyright allows, resulting in products which are "defective by design".  What do you think about this?
